Cookies used on our sites include both “session cookies” that are deleted when a web browser session ends, “persistent cookies” that remain longer, “first party” cookies that we place and “third party” cookies that our service providers and other third parties place.

  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications.

  • Chat technologies, such as those provided by third parties that employ cookies and software code to operate the chat features that you can use to communicate with us through the Service. These third parties may access and use information about webpages visited on our website, your IP address, your general geographic information (e.g., city, state), and other personal information you share through online chats to respond to your questions and for the purposes described in this Privacy Notice.

  • Session-replay technologies, such as those provided by third parties that employ software code to record users’ interactions with the Services in a manner that allows us to watch video replays of those user sessions. The replays include users’ clicks, mobile app touches, mouse movements and scrolls during those sessions. These replays help us diagnose usability problems and identify areas for improvement.

For more information about our use of tracking technologies, please see our Cookies Notice.

Data Processing outside Your Jurisdiction

We are a U.S.-based company and many of our service providers, advisers, partners or other recipients of data are also based in the U.S. This means that, if you use the Service, your personal information will necessarily be accessed and processed in the U.S. It may also be provided to recipients in other countries outside of your jurisdiction.

It is important to note that that the US is not the subject of an ‘adequacy decision’ under the GDPR – basically, this means that the U.S. legal regime is not considered by relevant European bodies to provide an adequate level of protection for personal information, which is equivalent to that provided by relevant European laws.

Where we share your personal information with third parties who are based outside of your jurisdiction, we try to ensure a similar degree of protection is afforded to it by making sure one of the following mechanisms is implemented:

  • Transfers to territories with an adequacy decision. We may transfer your personal information to countries or territories whose laws have been deemed to provide an adequate level of protection for personal information by the European Commission or UK Government (as and where applicable) (from time to time), such as the US under the EU-US Data Privacy Framework, UK Extension to the EU-US Data Privacy Framework, or Swiss-US Data Privacy Framework, as applicable.

  • Transfers to territories without an adequacy decision.

    • We may transfer your personal information to countries or territories whose laws have not been deemed to provide such an adequate level of protection (e.g., the U.S., see above).

    • However, in these cases:

      • we may use specific appropriate safeguards, which are designed to give personal information effectively the same protection it has in Europe – for example, standard-form contracts approved by relevant authorities for this purpose; or

      • in limited circumstances, we may rely on an exception, or ‘derogation’, which permits us to transfer your personal information to such country despite the absence of an ‘adequacy decision’ or ‘appropriate safeguards’ – for example, reliance on your explicit consent to that transfer.

To the extent required by applicable law, you may contact us if you want further information on the specific mechanism used by us when transferring your personal information. You may have the right to receive a copy of the appropriate safeguards under which your personal information is transferred by contacting us at privacy@neurocrine.com.

EU-US and Swiss-U.S. Data Privacy Frameworks and UK Extension

Neurocrine Biosciences participates in and complies with the EU-US Data Privacy Framework (“EU-US DPF”), the UK Extension of the EU-US DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-US DPF”) (collectively, “DPF”) as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information from European Union member countries, the United Kingdom, and Switzerland.

As a DPF participant, Neurocrine Biosciences is committed to and has certified to the US Department of Commerce that it adheres to: (i) the EU-U.S. Data Privacy Framework Principles with regard to the processing of personal information received from the European Union; (ii) the UK Extension to the EU-US Data Privacy Framework Principles with regard to the processing of personal information received from the United Kingdom; and (iii) the Swiss-U.S. Data Privacy Framework Principles (collectively, the “DPF Principles”) with regard to the processing of personal information received from Switzerland. If there is any conflict between the terms in this Privacy Notice and the DPF Principles, the DPF Principles shall govern. To learn more about the DPF program, and to view our certification, please visit https://www.dataprivacyframework.gov/. Our commitments to the DPF program are subject to the investigatory and enforcement powers of the US Federal Trade Commission.

We may collect, use, and disclose personal information that is subject to the DPF Principles with our third-party service providers. We restrict their access, use and disclosure of personal information in compliance with our DPF obligations. Neurocrine Biosciences may be liable under the DPF if these third parties process such personal information in a manner inconsistent with the DPF, unless Neurocrine Biosciences proves that it is not responsible for the event giving rise to the damage.

You have the right to request access to personal information received by Neurocrine Biosciences in reliance on the DPF, and to exercise choice in limiting Neurocrine Biosciences’ use and disclosure of such information. If you are interested in exercising your rights and choices, please contact us at the address, phone number, or email address listed above or update your preferences via the cookie banner on our website, if applicable.

Neurocrine Biosciences does not use or share the personal information we collect for purposes other than the purposes we disclose to the relevant individuals. We do not use clinical trial participants’ personal information for purposes other than those described in the informed consent form and the study protocol for the relevant clinical trial. The informed consent form sets out choices trial participants may have under laws and regulations that govern clinical trials, such as the choice to withdraw consent for further participation in a clinical trial.

Neurocrine Biosciences does not use website visitors’ or mobile application users' or healthcare providers’ personal information for purposes other than those described in this Privacy Notice. Users of the Services and healthcare providers have the ability to opt out of receiving marketing communications, as described in this Privacy Notice.

We may be required to disclose personal information received by us in reliance on the DPF in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

In compliance with the DPF Principles, we encourage you to contact us at any time as specified in the Contact Us section above with questions, concerns, or complaints about our privacy practices and participation in the DPF. You may also refer a complaint to your local data protection authority and Neurocrine Biosciences will work with them to resolve your concern.

Neurocrine Biosciences has further committed to refer unresolved DPF complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. The JAMS services are provided at no cost to you. If neither Neurocrine Biosciences nor JAMS resolves your complaint, you may have the right to invoke binding arbitration under certain conditions. To learn more about this option, visit the DPF’s “How to Submit a Complaint” page.

Please note that the foregoing processes apply only to the resolution of disputes regarding personal information received by Neurocrine Biosciences under the DPF. All other disputes that you may have with Neurocrine Biosciences, or any agents, representatives, agencies, officers, directors, or employees, must be resolved in accordance with the terms and conditions of any applicable websites, mobile apps, email newsletters, email subscriptions or other digital properties owned or controlled by Neurocrine Biosciences.
